Compass Plan Agreement

This Accomplishr Compass Subscription Agreement ("Agreement") governs your access to and use of Compass, an Accomplishr subscription offering. By purchasing, accessing, or using Compass on Accomplishr.com, you agree to comply with this Agreement, which is incorporated into Accomplishr's Terms of Service and User Agreement by reference.

Accomplishr reserves the right to modify this Agreement and its associated terms at any time, to the extent permitted by applicable law. Modifications will take effect upon posting on the Site, unless stated otherwise. It is your responsibility to regularly review this Agreement for updates. Capitalized terms not specifically defined herein will have the meanings assigned in the Accomplishr User Agreement or Terms of Service.

Digital Signature

By purchasing a Compass subscription, accessing the platform, or submitting any assessment inputs, you consent to this Agreement electronically, consistent with:

• The Electronic Signatures in Global and National Commerce Act (E-Sign Act), 15 U.S.C. Sec. 7001 et seq.

• Relevant state laws, such as California Civil Code section 1633.8

By accepting, you confirm your ability to access, save, and print this Agreement and all incorporated terms.

1. Overview & Subscription Terms

   1. Product Offerings

      Compass is an Accomplishr subscription service structured to offer users structured assessments, periodic check-ins, personalized insights, recommendations, and guided growth playbooks. Compass utilizes a combination of rules-based logic, data analysis, machine learning models, and other technologies to generate personalized insights and recommendations.

   2. Subscription Model & Billing Cycles

      Quarterly and Yearly Auto-Renewal: Compass is initially offered as a quarterly and yearly auto-renewing subscription plans. By subscribing, you authorize Accomplishr to automatically charge your designated Payment Method at the start of each new billing cycle.

      Future Billing Options: Accomplishr reserves the right to introduce alternative billing cycles, including monthly subscription plans or other subscription terms. Once officially launched and made commercially available on the platform, any additional subscription terms, tier rates, and corresponding auto-renewal policies will immediately apply to users who select or opt into those plans during checkout or account modification.

      Cancellation: You may cancel your subscription at any time before the next billing cycle begins. Upon cancellation, your access to premium Compass features will persist until the end of your current paid period.

   3. Payment Methods, Taxes, & Fees

      Credit/Debit Only: Payment must be made strictly via valid credit or debit card.

      Additional Payment Methods: Accomplishr may, at its sole discretion, integrate and authorize additional payment methods over time, including but not limited to internal Accomplishr account balances, digital wallets, or alternative third-party processors. Any such payment methods will become active and available to you immediately upon their formal integration into the platform's checkout interface, and their use will be subject to the standard transaction rules established herein.

      Transaction Fees: All processed payments are subject to a 1.5% Stripe processing fee and an 8.5% flat tax rate.

      Platform Fees: Accomplishr charges 0% platform fees on Compass subscription transactions.

   4. Strict No-Refund Policy

      All processed payments for the Compass subscription are final, irrevocable, and completely non-refundable. No refunds, credits, or prorated adjustments will be issued for:

      • Partial use or early cancellation of a billing cycle.

      • Unused features, tools, or benefits.

      • Incomplete or abandoned structured assessments.

      • User dissatisfaction with the AI insights, milestone playbooks, or results.

   5. Explicit Feature Exclusions

      Your Compass subscription covers premium in-app software features only. It explicitly excludes any external or localized services, including but not limited to:

      • Fees for 1:1 expert consultations or BookNow sessions.

      • Paid Fireside Chats.

      • Paywalled or paid expert blog content.

   6. Platform Improvements & Feature Availability

      Accomplishr may modify, enhance, discontinue, or replace Compass features from time to time as part of ongoing product improvements. While we strive to provide advance notice of material changes when practical, we reserve the right to update the platform to improve functionality, security, performance, and user experience.

2. Disclaimers & Limitations of Liability

   1. AI/ML Insights & Scoring Disclaimers

      Algorithmic Generation: All insights, milestone scoring, and playbooks are generated using artificial intelligence, machine learning, and other automated technologies. These outputs are strictly derived from your self-reported inputs and platform activity metrics.

      Informational & Non-Diagnostic: Outputs are purely interpretive and informational. They should not be interpreted as professional, diagnostic, legal, medical, financial, or employment advice.

      Dynamic Reset: Certain Compass features, recommendations, and progress indicators may be updated or recalculated when you complete a new check-in.

   2. No Professional Advice or Guarantees

      Accomplishr provides tools for self-improvement and guidance, but does not provide financial, legal, medical, or other professional advice. Accomplishr makes no warranties or guarantees regarding specific career outcomes, corporate advancement, monetary success, or professional milestones resulting from the use of Compass.

   3. Marketplace Separation

      Experts, coaches, and content creators on Accomplishr are independent users, not agents or employees of Accomplishr. They operate autonomously, host separate sessions, and set their own independent rates. Accomplishr acts solely as a technology platform and does not guarantee independent expert service quality, accuracy, operational availability, or booking success.

   4. Global Attendance & Time-Zone Tracking

      Compass and related live programming operate on a global scale. Users are solely and entirely responsible for tracking time-zone conversions. Accomplishr assumes zero liability for missed sessions, live events, or scheduling misalignments caused by user oversight.

3. Disputes, Data, & Ownership

If you experience a billing issue, technical concern, or subscription-related dispute, you agree to first contact Accomplishr through the support channels made available on the platform. Accomplishr will review submitted inquiries and make reasonable efforts to investigate and respond in a timely manner.

      • No Refund Bypass: Contacting support does not alter the applicability of any refund limitations described in this Agreement. Before initiating a chargeback or payment dispute with your financial institution, you agree to provide Accomplishr with a reasonable opportunity to investigate and address the issue. Fraudulent, abusive, or bad-faith disputes may result in account suspension or termination.

   2. Privacy & Data Usage

      By utilizing Compass, you acknowledge that Accomplishr collects your assessment responses, profile data, and in-app behavioral metrics to personalize your playbooks, generate insights, and improve Compass functionality, recommendations, personalization systems, analytics, and related platform services.

      We retain your personal and behavioral data only for as long as necessary to fulfill the purposes outlined in this Agreement or to comply with our legal obligations. You may request the deletion of your account and associated personal data at any time through your account settings, subject to our standard data retention and backup policies. To protect your privacy, we may de-identify, aggregate, or anonymize information so that it can no longer reasonably be linked back to you, which we may retain and use indefinitely for analytical purposes. When utilizing third-party AI models or Large Language Models (LLMs) providers via API connections to generate specialized insights, we securely transmit the minimum required contextual data and strictly prohibit those third-party providers from using your data to train their own external models.

   3. Content Licensing

      Platform Materials: All structured assessments, tools, UI elements, and milestone playbooks are proprietary property licensed to you for personal use only. They are not transferred, and they may not be copied, shared, or resold.

      Expert IP: Independent Experts retain full ownership of their proprietary content, articles, and media, while granting Accomplishr a broad, royalty-free license to host, display, and distribute it across the platform.

4. Notices & Account Enforcement

   All automated notices, system receipts, and critical communications regarding your Compass subscription will be sent to your registered email address. It is your sole responsibility to maintain an accurate email address and monitor your inbox regularly.

   Accomplishr reserves the right, at its sole discretion, to limit your tool access or immediately suspend your account if it detects fraudulent billing behavior, exploitation of platform protocols, or abuse of the help desk dispute program.
